Apple wins ban on Samsung phones in Europe

Apple has won an injunction to stop a Dutch court on Wednesday, Samsung Electronics is marketing three models smartphone in some European countries after the patent infringement. Apple and Samsung are locked in a bruising battle of patents in the United States, Europe and Asia, as they try to first place in the smartphone market after Nokia, the market leader in decades, was ousted in the second quarter.


Apple said that Samsung had violated three of its patents. The court ruled that Samsung's smartphones Galaxy S, S II and Ace violated a patent from Apple. Apple patent allows a certain displacement method or browsing through photos on some smartphones from Samsung, the court said.

"It's no coincidence that Samsung's latest products look a lot like the iPhone and iPad, from the shape of the hardware to the user interface and even the packaging," Apple said. The court dismissed all other demands by Apple, saying there were no violations of two other Apple patents, no violations for Samsung's tablet computers Galaxy Tab, and no violations of model rights. And there was no "slavish style copying", the court added.  

Patent infringement could be solved by technical changes in smartphones, the court ruled. This would allow the sale of smartphones.
